Waiver for kayaking & acknowledgment of risk

In consideration of being allowed to participate in activities organised by UQ Canoe Club Incorporated ("UQCC"), their employees, volunteers, members and all other persons or entities in any capacity on their behalf and to use equipment owned by UQCC. I hereby agree to release and discharge UQCC in perpetuity, on behalf of myself, my children, my parents, my heirs, distributes, assigns, personal representatives and estates as follows:

1. I acknowledge that the use of kayaks, canoes, and other paddle craft entail unanticipated risks which could result in physical or emotional injury, paralysis, death or damage to myself, to property or third parties. I understand that such risks simply can not be eliminated without jeopardising the essential qualities of activity. I understand that I alone am fully responsible for my own safety and the safety of my personal property and that UQCC is in no way liable for my well being. I intend this release to apply to all my activities with UQCC or while using UQCC's equipment. I understand that all equipment & facilities provided or utilised by UQCC is provided on an "as is" condition and is not warranted in any way by UQCC. I expressly agree and promise to accept all of the risks existing in the use of UQCC's equipment and my participation in any activity sponsored by UQCC. My participation in any activity and use of equipment is on a purely voluntary basis, and I elect to participate in spite of the acknowledged risks. I will exercise my own good judgement and will not partake in any event where I am not confident in my own ability.
2. I hereby voluntarily release, forever discharge, agree to indemnify, and hold harmless UQCC and agree to waive any claims, demands, or cause of action, which are in any way connected with my participation in my paddling activities or my use of UQCC's equipment. Including such claims, which neglect acts or omissions of UQCC. I realise there are risks of becoming seriously ill or injured in a remote area, far from medical care, and that UQCC cannot guarantee the availability of emergency medical services or transportation to medical facilities. I understand that I am solely responsible for all charges for medical and emergency services and rescue operations that I may need. I certify that I have adequate insurance to cover personal injury or damage.
3. By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in any activity or while using any equipment, I may be found in the court of law to have waived my right to maintain a lawsuit against UQCC. I have carefully read this agreement and fully understand its contents.
4. I hereby confirm I am 18 years of age or older, am able to swim, and agree to all of the above conditions.
